Booking Terms and Conditions
1. Payment Schedule
An invoice will be issued upon the completion of the booked sessions. Full payment is required within fourteen (14) days from the date of the final session.
2. Cancellation Policy
No deposit is required to secure a booking. However, if a cancellation is made within six (6) weeks of the first scheduled session, a cancellation fee of twenty percent (20%) of the total booking cost will apply.
3. Late Payment
A late payment fee of $20 may be applied for each 7-day period that payment is overdue. If payment is not received within 14 days after the due date, the outstanding amount may be referred for collection, with all associated costs borne by the client.
4. Force Majeure
Neither party shall be liable for any failure to perform its obligations under this agreement due to events beyond its reasonable control, including but not limited to acts of God, war, government action, fire, flood, or other natural disasters.
5. Refund Policy
Refunds will not be issued except in cases where the provider fails to deliver the services as outlined in the agreement. In such cases, the refund will be prorated based on the services rendered up to the point of cancellation.
6. Client Responsibilities
The client (i.e., the primary school) is responsible for providing all necessary information, cooperation, and access required to complete the sessions. Failure to do so may result in delays or additional fees.
7. Intellectual Property
Any materials or resources provided by the provider during the sessions remain the intellectual property of the provider. The client agrees not to reproduce, distribute, or otherwise use these materials without the provider’s written consent.
8. Liability
The provider will not be held liable for any direct, indirect, or consequential losses arising from the use of the services provided, except where such liability is mandated by law.
9. Confidentiality
Both parties agree to maintain the confidentiality of all information disclosed during the sessions, except where disclosure is required by law.
10. Termination
The provider reserves the right to terminate the agreement at any time if the client breaches any of the terms and conditions, fails to make payments, or engages in any conduct deemed inappropriate.
11. Governing Law
These terms and conditions are governed by and shall be construed in accordance with the laws of South Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of South Australia.
